Acquiring property:
Citizens of and legal entities established in Azerbaijan may acquire land plots on the basis of the right to property, use and lease.
- Right to property
Private property right (full ownership) may be acquired through privatization of land plots owned by state and municipality, sale and purchase contract, inheritance, gift, exchange contract, other transactions with regard to land plots or transfer to charter capital of legal entities.
- Right to use
Right to use land plot may be permanent and temporary, while temporary use of land plot itself may be long-term and short-term. Short-term use may be granted up to 15 years, while long-term use may be granted from 15 up to 99 years (for privately owned land plots) and from 15 years up to 49 years (for land plots owned by state and municipality).
- Right to lease
Right to lease of land plot may be granted to the citizens and legal entities of the Republic of Azerbaijan, foreigners and stateless persons, foreign legal entities, international associations and organisations, and foreign states.
In relation to state-owned land plots relevant executive authorities (it can be the State Service on Property Issues under the Ministry of Economy, the Ministry of the Environment and Natural Resources and local executive authorities as the case may be) act in the capacity of lessor. Terms and conditions of the lease, its duration, and rental fee are set out in the contract entered into between the parties thereof upon their mutual consent.
Acquiring citizenship:
A foreigner or stateless person who lives continuously for the last 5 years in the territory of the Republic of Azerbaijan on legal bases, has a legal source of income, undertakes obligation on observing Constitution and laws of the Republic of Azerbaijan, as well as submits the document certifying his/her knowledge of the state language of the Republic of Azerbaijan may be admitted to the citizenship of the Republic of Azerbaijan upon his/her own application according to the legislation regardless of his/her origin, race and nationality, gender, educational background, religion, political and other convictions.
Persons who live in the territory of the Republic of Azerbaijan apply to the State Migration Service, and persons who live abroad apply to the Ministry of Foreign Affairs via diplomatic representations or consulates of the Republic of Azerbaijan for restoration and revocation of citizenship of the Republic of Azerbaijan.
Documents required for acquisition of the citizenship of the Republic of Azerbaijan by foreigners and stateless persons
- Application form (filled in via computer) – printed in 2 copies;
- Application (written via computer) addressed to the President of the Republic of Azerbaijan – printed in 2 copies;
- CV (written via computer) - printed in 2 copies;
- 4 photos sized 3x4 cm;
- Receipt on payment of the state fee (200 manats);
- Reference from the Ministry of Education certifying the knowledge of official language of the Republic of Azerbaijan;
- Copy of passport or other border-crossing document (except persons without those documents who obtained refugee status, as well as persons whose statelessness and permanent residence in the Republic of Azerbaijan determined by the court) – (attach a notarized translation);
- Document certifying the existence of legal income (one of the following documents: reference from workplace, reference on receiving pension, stipend or targeted state social assistance, reference from tax authority on incomes of physical person, reference on receiving alimony, reference on income of guardian, certificate of inheritance, etc.).
